1. In accordance with the Interpretation Letter, Ref. No. Si-Fa-Yuan-S-Tzi No. 785, promulgated on November 29, 2019, the competent authority is requested to develop a prescriptive framework conforming to the protection requirements for serving public duty and healthcare rights by the Constitution within 3 years from the date of promulgation.
2. Under this circumstance, the Ministry of Justice, based on above subject interpreted, takes the charge by referring to the shift system, rotated time-off system adopted by each business-specified authority for research and discussion, planning duty specification fitting actual needs and the Constitution, which governs rules of 1:1compensation for employees who had overtime work lasting more than legal office hours
3. We have two preliminary trial scenarios designed to fit the needs of our colleagues among correction agencies, "Advanced Next Day" and "12-hour Two-shift System”; we also chosen some agencies for this trial scenario and is in progress pending with the result for further evaluation and discussion on new generation of system to adopt.
4. In addition to showing the respect to our above trial scenario and practices, the Ministry of Justice also charged us to simultaneously collect other relevant service systems of specified agencies with shifting public servant, and refer to the essential thoughts of the amendment to the Civil Servant Work Act, the Civil Servant Protection Act and others, incorporated with the result of above trials, insisting on mind-opened talks with our colleagues among agencies, instead of what they said that we have finalized the case or it will be the Ministry of Justice the dominant authority for specific scenario and so on.
